Enterprise Rancheria Casino EIS Upheld by Federal Court

Challenges by competing tribes were rejected in a decision by a federal judge on September 24, 2015. The proposed Enterprise Rancheria Casino will be located in Yuba County, CA, near Marysville. The competing tribes alleged a wide range of supposed deficiencies in the EIS; one of the more interesting arguments being that light from the proposed hotel would interfere with the view of the Sutter Buttes, a small mountain range 30 miles northwest of the proposed site. In response to this and other similar assertions, the court found “… the BIA performed a proper analysis of the relevant impacts that were raised during the NEPA process.” The court also agreed that “… competition alone is not enough of a detrimental impact to sustain this NEPA challenge.” The Environmental Impact Statement for the project was prepared by AES under the direction of the U.S. Department of the Interior, Bureau of Indian Affairs.
