EIS on Ione Tribe Casino Project Upheld By Federal Court

Litigation regarding the approval by the U.S. Department of the Interior of an application by the Ione Band of Miwok Indians for land in trust has been decided by Judge Troy Nunley in favor of the Department and the Tribe. Among other things, the litigation challenged the adequacy of the NEPA Environmental Impact Statement (EIS) for the project. The EIS, prepared by Analytical Environmental Services (AES) under direction of the Bureau of Indian Affairs, exhaustively examined potential environmental impacts of the proposed 228 acre trust acquisition and casino resort project in Amador County, CA. The federal court found the federal government’s environmental analysis of the project covered all foreseeable consequences and the plaintiffs “do not identify specific concerns” with the conclusions of the EIS.
